1 The learned counsel for the applicant seeks leave to amend

the application so as to join the First Informant as party

respondent. Leave to amend, as prayed, is granted.

2 Heard the learned counsel appearing for the applicant/

original accused. Perused the First Information Report (FIR)

lodged by First Informant Rachana Kakani which has resulted in

registration of Crime No.12 of 2008 for offences punishable under

avk 1/2

Sections 498A, 406, 465, 468, 471, 506 read with 34 of the Indian

Penal Code. Allegations qua the applicant, who happens to be the

married sister of the deceased husband, is to the effect that

whenever she used to come to her parental house, she used to join

her other relatives in committing mental as well as physical

cruelty.

3 Issue notice to respondents, returnable on 30th April 2020.

4 The learned APP waives notice for respondent no.1/State.

5 In the meanwhile, interim relief in terms of Prayer Clause

(c) qua the present applicant alone.

6 Needless to mention that the subject criminal case as against

other accused persons can go on.
