ORAL ORDER

1. Learned advocate Ms.J.M. Talati for the applicant has filed
sick-note.

2. By way of the present application, the applicant has
prayed for the following relief:-

“12(b). This Hon’ble Court may be pleased to quash
and set aside the impugned FIR at Annexure-A being
CR.No.I-120/2017 registered with Vastrapur police
station, and chargesheet thereof against the applicant
being the original accused No.3 for the offences
punishable under Sections 323, 498A, 294(A) and 114
of the Indian Penal Code; in exercise of the powers
under Section 482 of the Code of Criminal Procedure,
1973.”

3. The learned A.P.P. states at bar that the chargesheet is
filed in the matter.

4. Having heard submissions made at bar and considering
the averments made in the present application, no case is
made out to entertain the present application without availing

alternate remedy to file discharge application. Therefore, the
present application is not entertained at this stage. However,
the applicant is at liberty to file discharge application and also
to file appropriate proceedings either u/s 397 or 482 of the
Code of Criminal Procedure, 1973 before appropriate
competent Court, after remedy to file discharge application is
availed.

5. It is clarified that this Court has not examined the merits
of the present application.

6. Accordingly, present application stands disposed of.
