1] The applicant is apprehending arrest in CR No. 305 of 2018 dated

24.11.2018 registered with Chiplun Police Station, District- Ratnagiri under

section 498A, 323, 307, 504 read with 34 of Indian Penal Code.

2] Heard the learned Counsel for the applicant and the learned APP.

Perused the record.

3] Perusal of the first information record would reveal that, the same is

lodged out of matrimonial dispute and/or discord between the first informant

and her husband the applicant No.1 Rupesh Kadam.

During the course of arguments, the learned APP submitted that, the

first informant may be added as necessary party and the parties may be referred

to mediation to resolve the matter amicably.

4] In view thereof, the applicants are directed to implead the first

informant Mrs. Rupashri Kadam as respondent No.2. Amendment be carried out

within a period of two weeks from today. After amendment is carried out, issue

notice to the newly added respondent.

In addition to Court Notice, the applicants are permitted to serve the

respondent No.2 by private notice and after the said respondent is duly served to

file an affidavit to that effect.

5] Till next date, the applicants are protected by interim relief.

Hence, the following Order:-

i] In the event of arrest in CR No. 305 of 2018 registered with the

Chiplun Police Station, District- Ratnagiri, the applicants shall be released on bail

on their furnishing PR bond in the sum of Rs.15,000/- each with one or two local

sureties in the like amount.

ii] Applicant shall attend the Investigating Officer from 2 nd January

2019 to 4th January 2019 between 10.00 a.m to 1.00 p.m and to join in the

process of investigation.

iii] Applicants shall not tamper with the evidence and/or influence the

prosecution witnesses.

6] Stand over to 23rd January 2019.
