Wife is in the revision petition seeking enhancement of
maintenance pendente lite fixed by the trial Court under Section 24 of the
Hindu Marriage Act.
Petitioner-wife claims that the husband is earning Rs.10,000/-
while working as a driver and she is entitled to maintenance pendente lite
@ Rs.5,000/-. On the other hand, the respondent-husband claims that he
has no source of income. Learned trial Court has fixed the maintenance
pendente lite @ Rs.2,000/- per month after assessing the income to be
Rs.7,000/-per month as an ordinary unskilled worker.
In the considered opinion of this Court, Rs.2,000/- per month is
totally insufficient for maintaining an individual during these days. An
ordinary unskilled worker earns more than Rs.10,000/- even while working
on menial jobs in the State of Haryana, from where the party belongs.
In view thereof, maintenance pendente lite is enhanced
Rs.4,000/- per month from the date of the application.
Revision petition is allowed.
