behalf of the opposite party.
In this application the petitioner has challenged the order dated June 11, 2019
passed by the learned Additional District Judge, Fast Track, 4th Court at Barrackpore,
District 24 Parganas (North) by which the learned court below directed that the
application of the wife for maintenance pendente lite should be taken up along with
hearing of the main suit.
It is the contention of the petitioner that the entitlement of the petitioner for
maintenance pendente lite for herself and her minor son should be decided prior to the
final disposal of the suit, inasmuch as, the very concept of maintenance pendente lite gets
frustrated if the said application is heard along with the main suit. There will be a stay of
all further proceedings in MAT Suit No.1415 of 2018 pending before the learned
Additional District Judge, Fast Track, 4th Court at Barrackpore, District 24 Parganas
(North) up to February 29, 2020 or until further order whichever is earlier.
List this matter in the daily supplementary list on February 7, 2020.
The learned advocate for the petitioner is directed to serve a notice upon the
learned advocate appearing on behalf of the opposite party in the learned court below
along with a server copy of this order intimating the learned advocate that the matter will
be disposed of on the next date if none appears on behalf of the opposite party. Affidavit-
of-service to be filed on the next date.
