This is an application under Section 439 Cr.PC, praying for bail of the petitioner,Saidur
Rahman, who is in detention in connection with Boko PS Case No. 825/2019 (GR No.
2268/2019) under Section 354 IPC R/W Section 67(B) of Information Technology Act, 2000,
R/W Section 12 of POCSO Act.

Heard Mr. N. Ahmed, learned counsel for the petitioner and also Mr. NJ Dutta, learned
Addl. P.P. for the respondent.

Case diary produced today is perused.

Learned counsel for the petitioner submits that the petitioner has been in custody for
53 days.

Having considered the materials in the case diary and the length of detention, this
court is of the view that further detention of the petitioner may not be necessary in the
interest of investigation. Accordingly, the petitioner is allowed to be enlarged on bail of Rs.
20,000/- with one suitable surety of the like amount to the satisfaction of the learned JMFC,
Boko). The bail is subject to the following conditions.

1. The petitioner shall attend in accordance with the conditions of the bond
executed.

2. The petitioner shall not commit an offence similar to the offence of which he is
accused, or suspected, of the commission of which he is suspected, and

3. The petitioner shall not directly or indirectly, make any inducement, threat or
promise to any person acquainted with the facts of the case so as to dissuade
him from disclosing such facts to the court or to any police officer or hamper
with the evidence.

Bail application is disposed of.
