Judgment

Petitioner has filed this petition under Section 438 Code of

Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No.

747/2018 registered at Police Station Shiprapath, Jaipur for

offences under Sections 323, 341, 509 of Indian Penal Code,

1860.

Learned counsel for the petitioner has submitted that the

petitioner is not named in the FIR. There is a delay of four days in

lodging the FIR. In the initial complaint moved by the

complainant, there was no allegation of commission of offence

under Section 354 Indian Penal Code, 1860.

On 19.11.2018 following order was passed by this court:-

“List again on 11.12.2018. In the
meantime, in the event of arrest, petitioner be
released on interim bail subject to the
satisfaction of the Arresting Officer. Petitioner
(2 of 2)

shall abide by the conditions envisaged under
Section 438 (2) Cr. P.C.”

Learned State counsel has submitted that in pursuance to

the above order, petitioner has joined investigation.

Keeping in view the facts and circumstances of the case and

the fact that the petitioner has joined investigation, interim bail

granted to the petitioner by this Court vide order dated

19.11.2018, is made absolute.

Petition stands disposed of accordingly.
