P.C. :

1. Heard learned Counsel for the applicant.

2. By this application, the applicant seeks pre-arrest bail in

connection with C.R. No.314 of 2019, registered with the Oshiwara Police

Station, Mumbai for the alleged offences punishable under Sections 498A,

406, 509, 354, 506, 504 r/w 34 of the Indian Penal Code.

3. The applicant is the husband of the complainant. According to

the complainant, she got married to the applicant sometime in 2000 and

from the said wedlock, has two children aged 16 and 11.

4. Learned Counsel for the applicant states that the allegations as

against the applicant are false and baseless. He further submits that no

stridhan as alleged is with the applicant. Learned Counsel for the applicant

relied on discrepancies in the amount mentioned in the F.I.R and in the

Police report.

5. Having regard to what is stated aforesaid, it would be

necessary to implead the complainant as party respondent. Accordingly,

leave to amend is granted to the applicant. Amendment to be carried out

forthwith. The complainant to be impleaded as party respondent No.2.

Issue notice to added respondent No.2 returnable on 21st November, 2019.

6. In the meantime, till the next date, the applicant is granted

interim protection on the following terms and conditions :-

ORDER

(i) In the event of the arrest, the applicant be enlarged on bail on

furnishing P.R. Bond in the sum of Rs.20,000/-, with one or two

sureties in the like amount ;

(ii) The applicant shall report to the Investigating Officer of the

concerned Police Station as and when called;

7. Stand over to to 21st November, 2019.

8. All concerned to act on the authenticated copy of this order.
