Learned State counsel on instructions from ASI Bachan
Singh, Police Station Ballabgarh, District Faridabad, submits that
petitioner Shivam Kumar has been declared proclaimed offender in
this case bearing FIR No. 435 dated 06.10.2016 under Section
377 IPC and Section 4 of the POCSO Act pertaining to Police Station
Sadar Ballabgarh and in the light of the same, the present petition by
proclaimed offender, prima facie, is not tenable.
At this stage, faced with the likely consequences, counsel
for the petitioner has made a statement withdrawing the present
petition, however, reserving the rights of the petitioner to first
challenge the order declearing the petitioner as proclaimed offender
and, thereafter, approach this Court afresh on same very grounds.
Allowed to do so.
Dismissed as withdrawn with liberty aforesaid.
