Learned advocates for the petitioners, the opposite party no. 2 and the
State are present. I have heard them in respect of the compromise petition being
CRAN 4439 of 2017 whereby the defacto complainant has entered into a
settlement with her husband for quashing of the proceeding being G.R.Case No.
3040 of 2016 arising out of Baguiati Police Station Case No. 817 of 2016 dated
August 5, 2016 under Sections 498A/323/506/34 of the Indian Penal Code and
Sections ¾ of Dowry Prohibition Act, pending in the Court of the learned Chief
Judicial Magistrate, Barasat, inter alia, on the grounds stated therein that the
parties have arrived at amicable settlement that their dispute having been settled
and they do not want to continue with the present criminal proceeding and it will
be futile of exercise and abuse of the process of the Court if the proceeding for
quashing of the criminal proceeding is kept pending.
Learned advocate for the State has submitted a letter addressed to the
Officer-in-charge of Baguiati Police Station by Dibbya Sinha wherefrom it is
revealed that she has entered into a compromise with her in-laws and her
husband and she does not want to proceed with the case and wants to withdraw
the FIR No. 817 dated August 5, 2016.
Therefore, the CRAN being 4439 of 2017 for the appropriate order on
compromise application is considered and allowed. Consequently, the proceeding
under reference above be quashed.
Thus, the CRAN 4439 of 2017 and the revisional application being 3507 of
2017 stand disposed of.
Urgent xerox certified copy of this order, if applied for, be given to the
parties after completion of all legal formalities.
