The petitioners undertake to affirm and stamp the petition as
per the Rules within 48 hours of resumption of normal functioning
of the court. The petition is taken up through video conference on
the basis of such undertaking.
The allegations against the petitioners pertain to demands for
dowry and the alleged attempt by the husband of the de facto
complainant to smother the de facto complainant with a pillow some
time in September or October, 2019.
Since the de facto complainant has left the matrimonial home
and is at her paternal home at present and the allegations appear to
be of general nature, there may not be any need for the custodial
interrogation of the petitioners as long as they report to the
investigating officer once a fortnight till the investigation is
Accordingly, in the event of arrest, the petitioners will be
released on bail upon furnishing security of Rs.10,000/- (Rupees
ten thousand) each together with personal release bonds of
equivalent value to the satisfaction of the arresting officer. In
addition, the petitioners will abide by the conditions laid down in
section 438(2) of the Code.
