In Re: – An application for Anticipatory bail under Section 438 of the
Code of Criminal Procedure in connection with Matigara P.S. Case
No.8 of 2020 dated 06.01.2020 under Sections 498A/307 of the
Indian Penal Code read with Sections 3/4 of the Dowry Prohibition
Act, 1961.

And

In the matter of: Santanu Biswas Anr.

….Petitioners.

Mr. Shibaji Kr. Das
…for the Petitioners.

Mr. N. Ahmed
Mr. Anowar Hossain
Ms. Z. N. Khan.

…for the State.

The petitioners undertake to affirm and stamp the petition as

per the Rules within 48 hours of resumption of normal functioning

of the court. The petition is taken up through video conference on

the basis of such undertaking.

The allegations against the petitioners pertain to demands for

dowry and the alleged attempt by the husband of the de facto

complainant to smother the de facto complainant with a pillow some

time in September or October, 2019.

Since the de facto complainant has left the matrimonial home

and is at her paternal home at present and the allegations appear to

be of general nature, there may not be any need for the custodial
2

interrogation of the petitioners as long as they report to the

investigating officer once a fortnight till the investigation is

completed.

Accordingly, in the event of arrest, the petitioners will be

released on bail upon furnishing security of Rs.10,000/- (Rupees

ten thousand) each together with personal release bonds of

equivalent value to the satisfaction of the arresting officer. In

addition, the petitioners will abide by the conditions laid down in

section 438(2) of the Code.

CRM 3108 of 2020 and CRAN 1496 of 2020 are disposed of.
