1 The petitioner herein is an accused in C.C. No.1969/PW/2012

pending before the Metropolitan Magistrate, 66th Court, Andheri wherein

the petitioner is being tried for offences punishable under section 498A

Indian Penal Code along with his parents.

2 The learned counsel for the petitioner submits that the Court

has completed the recording of evidence and the matter is fixed for final

hearing but the same is being adjourned on one or the other count at the

request of the original complainant who happens to be the Respondent

No.2 in the present case. It is submitted by the learned counsel for the

petitioner that the parents of the petitioner are about 82 years and 76 years

old respectively.

3 This Court had issued notice to the respondent on 5 th July

2019. As of today, the learned counsel for the petitioner, upon instructions,

seeks liberty to withdraw the petition. Liberty as prayed for in the interest

of justice.

4 The learned Metropolitan Magistrate, 66th Court at Andheri is

hereby directed to conclude the pleadings before 30 th April 2020 and shall

not grant unwarranted adjournment at the request of the respondent. With

these directions, the petition is disposed of. Parties to act upon an

authenticated copy of this order.
