This appeal is preferred against the order dated 01.11.2018 by
which application filed under Section 24 of the Hindu Marriage Act, 1955
[for short ‘the Act’] by the respondent/wife has been allowed and `8,000/-
per month has been ordered to be paid towards maintenance pendente lite
and `8,000/- towards litigation expenses.
The only grievance of the appellant is that the appellant has
already been burdened with payment of `4,000/- by the Additional Chief
Judicial Magistrate, Jhajjar vide order dated 17.1.2018 on a petition filed
under Section 12 of the Protection of Women from Domestic Violence Act,
2005 [for short ‘the DV Act’].
Learned counsel for the appellant has submitted that the
appellant is not liable to pay the maintenance both under the DV Act as well
as the Hindu Marriage Act.

Be that as it may, if this is the only grievance, the appellant may
file an appropriate application before the District Judge, Jhajjar, who had
passed the order dated 1.11.2018, for seeking clarification.
In view thereof, learned counsel for the appellant prays for
withdrawal of the appeal in order to file an appropriate application before
the District Judge, Jhajjar at the first instance.
Dismissed as withdrawn.
Liberty granted.
