1 Heard learned counsel for the applicants.

2 By this application, the applicants seek pre-arrest bail in

connection with C.R. No. 325 of 2019 registered with the Bangur Nagar

Police Station, Mumbai, for the alleged offences punishable under Sections

306, Section498A, Section406 and Section34 of the Indian Penal Code.

3 The applicant No. 1 is the husband; applicant No. 2 is the

mother-in-law and applicant No.3 is the brother-in-law of deceased-Ruby.

4 Learned counsel for the applicants submits that the allegations

as against the applicants are not sufficient to attract the provisions of

Section 306 and Section498A of the Indian Penal Code. He submits that the

allegations as against the applicant No. 1 (husband) is that he was having

an affair with another woman prior to marriage. It is alleged that all the

applicants were ill-treating her and taunting her. Learned counsel for the

applicants states that the deceased was alone at home when she committed

suicide.

5 Learned A.P.P seeks time to take detailed instructions.

6 In the meantime, till the next date, the applicants are granted

interim protection on the following terms and conditions :

ORDER

(i) In the event of the arrest, the applicants be enlarged on bail on

executing P.R. Bond in the sum of Rs.15,000/- each, with one or two

sureties in the like amount;

(ii) The applicants shall report to the Investigating Officer of the

concerned Police Station on 17th and 18th October 2019 from

10:00 a.m. to 1:00 p.m, and thereafter, as and when called.
