In Re:- Anup Ghosh
… Petitioner
Mr. Raju Mondal
..for the Petitioner
Ms. Sayanti Santra
.. for the State
The petitioner seeks bail in connection with Chapra Police
Station Case No. 01/18 dated 01.01.2018 under Sections
498A/304B/302/120B/34 of the Indian Penal Code, 1860.
Considering the nature of the petitioners’ involvement as evident
from the case diary this second prayer cannot be acceded to on
merits.
The State says that the mother-in-law of the victim who had
applied for anticipatory bail has not yet surrendered.

Since the delay in this case may not be the State’s doing, the
State can only be requested to expedite the process once the
petitioners’ mother has surrendered.
However, since the petitioners have been in custody for a long
period, the State is requested to ensure that the trial is commenced
and meaningfully carried forward without undue delay.
C.R.M. 7322 of 2018 is thus rejected.
A certified copy of this order be immediately made available to
the petitioner subject to compliance with all requisite formalities.
