In Re.: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure
filed on 18.04.2019 in connection with Naihati GRPS Case No. 48 of 2018 dated 02.12.2018 under
Sections 498A/304B of the Indian Penal Code.

It is submitted by the learned Counsel appearing for the petitioner

that the co-accused person has been granted anticipatory bail.

Learned Counsel appearing for the State opposes the prayer for

anticipatory bail.

Having considered the materials on record and bearing in mind

the nature of allegations and as co-accused person similarly

circumstanced with the petitioner has been granted pre-arrest bail, we

are inclined to extend the same privilege to the petitioner also.

Accordingly, we direct that in the event of arrest the petitioner

shall be released on bail upon furnishing a bond of Rs.10,000/-, with

two sureties of Rs.5,000/- each, one of whom must be local, to the

satisfaction of the arresting officer, subject to the conditions as laid

down in Section 438(2) of the Code of Criminal Procedure, 1973. In

addition, the petitioner is directed to meet the investigating officer at

such time and place as may be specified by the concerned police officer,

till the investigation is complete.

This application for anticipatory bail is, thus, allowed subject to

the conditions as indicated above.
