Sections 498A/304B Of The Indian … vs In Re: Salema Bibi on 24 February, 2020

Court No.28
Sl No.72
CRM 2026 of 2020

In Re: An application for anticipatory bail under Section 438 of the
Code of Criminal Procedure filed on 20.02.2020 in connection with
Mogra P.S. Case No.339 of 2019 dated 30.12.2019 under
Sections 498A/304B of the Indian Penal code.

In Re: Salema Bibi
… … Petitioner.

Mr. Suman Chakraborty
… for the petitioner.

Ms. Faria Hossain,
Ms. Baisali Basu
… … for the State.

Having considered the materials on record disclosing prima

facie involvement of the petitioner in torturing the victim who was

compelled to commit suicide within five years of marriage and as

the petitioner does not stand in the same footing with co-accused

Masura Bibi @ Masura Khatun, married sister-in-law of the

victim/housewife, we are not inclined to grant anticipatory bail to

the petitioner.

The application for anticipatory bail is, thus, rejected.
