C.R.M. No. 1085 of 2019

In Re.: An application under Section 438 of the Code of Criminal Procedure filed on 22.01.2019
in connection with Kotwali Police Station Case No. 660 of 2018 dated 18.12.2018 under
Sections 498A/306/34 of the Indian Penal Code added Section 302 of the Indian Penal Code.

It is submitted by the learned Counsel appearing for the

petitioner that victim housewife committed suicide 17 years after

marriage and there was an illicit relationship between the victim and

one K. Mondal.

Learned Counsel appearing for the State opposes the prayer for

anticipatory bail.

Having considered the materials in the case diary and bearing in

mind the nature of allegations in the light of the aforesaid submissions

made on behalf of the petitioner with regard to illicit relationship

between the victim and one K. Mondal, we are of the opinion that the

petitioner may be granted anticipatory bail.

Accordingly, we direct that in the event of arrest the petitioner

shall be released on bail upon furnishing a bond of Rs.10,000/-, with

two sureties of like amount each, to the satisfaction of the arresting

officer and also subject to the conditions as laid down under Section
2

438(2) of the Code of Criminal Procedure, 1973 and on further

condition that he shall meet the investigating officer once in a week

until further orders.

This application for anticipatory bail is, thus, allowed.
