C.R.M. No. 1136 of 2018

In Re.: An application under Section 438 of the Code of Criminal Procedure filed on 06.02.2018
in connection with Chakdaha Police Station Case No. 14 of 2018 dated 10.01.2018 under
Sections 498A/307/34 of the Indian Penal Code.

We have considered the averments in the petition. We have also

noted the materials in the Case Diary and we find that the allegations

of torture are general and omnibus in nature and the allegation of

physical assault is not supported by medical evidence. Hence, we are

of the opinion that petitioners may be granted anticipatory bail in the

instant case.

Accordingly, we direct that in the event of arrest the petitioners

shall be released on bail upon furnishing a bond of Rs.10,000/- each,

with two sureties of like amount each, to the satisfaction of the

arresting officer and also subject to the conditions as laid down under

Section 438(2) of the Code of Criminal Procedure, 1973.

This application for anticipatory bail is, thus, disposed of.
