In Re: Umbar Mondal Ors. ….. petitioners
Mr. Debarshi Brahma
…..for the petitioners
Mr. Arijit Ganguly,
Mr. Avik Ghatak
….for the State
Learned Counsel appearing for the petitioners submits that
petitioner no 3 has already been arrested.
Hence, application for anticipatory bail is dismissed as not
pressed so far as petitioner no. 3 is concerned.
Having considered the materials on record and bearing in mind
the extent of complicity of the petitioners no. 1, 2 and 4 i.e. the in-laws
of the victim housewife in the alleged crime and as the principal
accused i.e. the husband has been released on regular bail, we are
inclined to grant anticipatory bail to them.
Accordingly, we direct that in the event of arrest the petitioners
no. 1,2 and 4 shall be released on bail upon furnishing a bond of
Rs.10,000/- each, with two sureties of like amount each, to the
2
satisfaction of the arresting officer and also be subject to the conditions
as laid down under Section 438(2) of the Code of Criminal Procedure,
1973 and on condition that the petitioners no. 1,2 and 4 shall appear
before the court below and pray for regular bail within a period of four
weeks from date.
This application for anticipatory bail is, thus, allowed so far as
petitioners no. 1,2 and 4 are concerned.
