Delay condoned. Leave granted. Heard learned counsel for the appellant. In the nature of order we propose to pass, it is not necessary to issue notice to the respondents, since the interest of both the parties is protected. The appellant seeks to withdraw the compensation amount deposited in the Reference Court.

The compensation is for the land acquired from the appellant. We permit the appellant to withdraw 50% of the amount deposited without any security. The remaining amount can be withdrawn on furnishing appropriate security to the satisfaction of the Reference Court. We make it clear that this order will apply to the deposits already made or to be made. The appeal is, accordingly, disposed of.
