Judgments of Supreme Court of India and High Courts

Shahnaj And 3 Ors. vs State Of U.P. And 2 Ors. on 15 March, 2018

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. – 1

Case :- CRIMINAL MISC. WRIT PETITION No. – 20299 of 2017

Petitioner :- Shahnaj And 3 Ors.

Respondent :- State Of U.P. And 2 Ors.

Counsel for Petitioner :- Phool Chandra Singh,Sumitra Singh

Counsel for Respondent :- G.A.

Hon’ble Ramesh Sinha,J.

Hon’ble Krishna Pratap Singh,J.

Case called out in the revised list. None appears on behalf of the petitioners to press the present writ petition. Sri Vikas Sahai, learned AGA for the State is present.

This writ petition has been filed by the petitioners with the prayer to quash the FIR dated 10.8.2017 which has been registered as Case Crime No.440 of 2017, under Sections 323, 498A I.P.C.,and 3/4 D.P. Act, Police Station Sahaswan, District Budaun.

From a perusal of the record it appears that the matter being matrimonial in nature, was refereed to the Mediation and Conciliation Centre of this Court vide order dated  20.9.2017. The report of the Mediation and Conciliation Centre dated  2.11.2017 is on record, from which it is evident that the petitioners have not complied with the order dated 20.9.2017 by which they were required to deposit Rs.15,000/- towards the Mediation and Conciliation Centre for the mediation process, hence, the mediation has failed.

The present writ petition lacks merit and is, accordingly, dismissed.

Interim order, if any, stands vacated.

( Krishna Pratap Singh, J.) (Ramesh Sinha, J.)

Order Date :- 15.3.2018
