Accused-petitioner has filed this post arrest bail application

under Section 439 Cr.P.C. which is founded on FIR No.35/2017 of

Police Station Varda, District Dungarpur for the alleged criminal

delinquency under Sections 306 and 498A IPC. Police, after

investigation, has filed charge-sheet in the matter against the

petitioner for the aforesaid offences.

I have heard learned counsel for the petitioner, learned

Public Prosecutor and perused the materials available on record.

Upon perusal of the materials available on record, more

particularly, the dying declaration of the deceased, without

expressing any opinion on merits of the case, I feel persuaded to

grant indulgence to the petitioner.

Consequently, the bail application under Section 439 Cr.P.C.

is allowed and it is ordered that accused-petitioner, Shailendra

Singh @ Lal Singh S/o Bharat Singh, arrested in connection with

FIR No.35/2017, Police Station Varda, District Dungarpur, may be

released on bail; provided he furnishes a personal bond of

Rs.50,000/- with two sureties of like amount to the satisfaction of

learned trial Court with the stipulation to appear before that Court

on all dates of hearing and as and when called upon to do so.
