The instant bail application under Section 439 Cr.P.C. is

arising out of FIR No.62/2017, registered at Mahila Police Station,

District Bikaner, wherein petitioner along with other accused

persons are charged for offence punishable under Sections 498A

304B IPC.

Police after investigation submitted charge-sheet in the

matter and presently trial in Sessions Case No.45/2017 is under

progress before Additional Sessions Judge (Women Atrocities

Cases), Bikaner (for short, ‘learned trial Court’).

I have heard learned counsel for the petitioner, learned

Public Prosecutor as well as learned counsel for the complainant at

length and perused the materials available on record.

Having regard to the facts and circumstances of the case and

taking into account a very vital fact that co-accused Nagesh Gaur,

husband of the deceased, has already been enlarged on bail and

petitioner is a senior citizen woman, without expressing any

opinion on merits of the case, I feel persuaded to enlarge her on

bail.

Accordingly, the bail application under Section 439 Cr.P.C. is

allowed and it is ordered that accused-petitioner Shakuntala Gaur

W/o Late Sh. Omprakash Gaur, arrested in connection with F.I.R.

No.62/2017, Mahila Police Station, District Bikaner, may be

released on bail; provided she furnishes a personal bond of

Rs.50,000/- with two surety bonds of Rs.25,000/- each to the

satisfaction of learned trial Court with the stipulation to appear

before that Court on all dates of hearing and as and when called

upon to do so.
