Manifestly, the alleged detenue Ms. Raunak Goyal is
lodged at Balika Gruh, Jodhpur, as per the admitted averments made
in the instant habeas corpus petition, and hence, she is not under
illegal detention. If the petitioner has any claim for seeking custody
of Ms. Raunak, she would have to file an appropriate application
under the provisions of the Juvenile Justice (Care and Protection of
Children) Act or the Guardians and Wards Act, as the case may be
for seeking the said relief.
In view of the above discussion, we find no merit in the
instant habeas corpus petition. Thus, the same is dismissed.
