C.R.M. 681 of 2018
sg Ct. No.28
In Re: – An application for anticipatory bail under Section 438 of the
(Allowed)
Code of Criminal Procedure filed on 19/01/2018 in connection with
Hanskhali P.S. Case No. 349/2017 dated 15.11.2017 under Sections
498A/306/34 of the Indian Penal Code adding Section 412 of the IPC.

And

In the matter of: Shampa Halder
….petitioner
Mr. S. Banerjee, Adv.

Mr. P. Dasgupta, Adv.

…for the petitioner
Mr. Swapan Bajernee, Adv.

Ms. P. Ghosh, Adv.

…for the State

It is submitted on behalf of the petitioner that the petitioner was employed in

Kolkata and did not play any role in the matrimonial life of the couple.

Learned lawyer for the State opposes the prayer for bail.

We have considered the materials on record and we find that the victim

committed suicide eight years after her marriage. In view of the extent of complicity of

the petitioner and bearing in mind the nature of allegations against the petitioner, which

are general and omnibus and in the light of the aforesaid submission on behalf of the

petitioner, we are inclined in granting anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing

bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of like amount to the

satisfaction of the arresting officer subject to the conditions as laid down under Section

438(2) of the Code of Criminal Procedure, 1973.

The application for anticipatory bail is, accordingly, allowed.

Urgent photostat certified copy of this order, if applied for, be supplied

expeditiously after complying with all necessary legal formalities.
