ORDER

The petitioner is the first accused

in Crime No.588/2019 of Kodungallur Police

Station registered for the offences

punishable under Sections 143, 147, 148,

341, 323, 324 and 307 r/w Section 149 IPC.

2. The petitioner was arrested on

3.7.2019.

3. Heard.

4. The learned Public Prosecutor has

submitted that the petitioner is involved in

a crime registered for the offence

punishable under Section 498A IPC. However,

the learned Public Prosecutor has further

submitted that the petitioner was not

involved in any other offence of similar

nature. It appears that the major part of

the investigation as regards the petitioner

is almost complete. Considering the facts

and circumstances of the case, including the

period of detention of the petitioner, the

stage of the investigation and also taking

into consideration of the fact that the

petitioner was not involved in any other

offence of similar nature, I am inclined to

grant bail to the petitioner.

In the result, this bail application

stands allowed and the petitioner shall be

enlarged on bail on condition of the

petitioner executing a bond for Rs.40,000/-

(Rupees Forty thousand only) with two

solvent sureties, each for the like sum to

the satisfaction of the Jurisdictional

Magistrate and subject to the following

further conditions:-

(i) The petitioner shall report
before the Investigating Officer
on every Saturday between 9 a.m.
and 11 a.m. for three months and
thereafter, as and when required
by the Investigating Officer for
interrogation.

(ii) The petitioner shall not
intimidate or influence the
witnesses or in any way tamper
with the investigation.

iii) The petitioner shall not
get involved in any other
offence during the pendency of
