Prayer in this petition filed under Section 482 Cr.P.C. is for

quashing the FIR No.651 dated 03.08.2016 registered under Sections 323,

498A, 506 IPC at Police Station Sadar, Karnal, District Karnal.

Petitioner is stated to be widow (mother-in-law of the

complainant), suffering from arthritis, breaking of nervous system and

thyroid. She is a chronic patient of the said diseases. The marriage between

the son of the petitioner with the complainant was solemnized on 21.12.2007

and out of this wedlock, two children were born i.e. a daughter and a son.

Notice of motion only to respondent No.1-State at this stage.

At the asking of the Court, Mr.Manish Bansal, DAG, Haryana,

accepts notice on behalf of respondent-State.

Let a copy of paper book be given to learned State counsel

during the course of the day.

To a specific query as regard the stage of the case, learned

counsel for the petitioner is fair enough in submitting that in the aforesaid

case, charge has been framed.

Considering the age and health condition as projected by the

petitioner, the present petition is disposed of with an observation that in case

the petitioner moves an application for exemption of her personal

appearance before the trial Court, the trial Court shall consider the same

sympathetically and unless there are reasons for her personal appearance,

she shall be considered for exemption from her personal appearance.
