1. The hearing has been conducted through Video Conferencing.

2. Exemption allowed, subject to the condition that petitioner will file
the duly sworn/attested affidavit and the requisite Court fee within 72 hours
from the date of resumption of the regular functioning of this Court.

3. The application stands disposed of.

4. By this application, appellant / petitioner seeks early hearing of
Crl.M.(Bail).No.1760/2019 pending in enbloc list. It is stated out of total
five years RI, the appellant has already undergone more than half of the total
sentence.

5. For the reasons explained, the early hearing is allowed.

7. The appellant was convicted under Section 354 IPC and Section 10 of
the POCSO Act per FIR No.225/2017 registered at police station Subhash
Palace and sentenced to RI for five years with fine of Rs.5,000/- in default

thereof one month SI. Per nominal roll dated 19.04.2021, the appellant has
already undergone more than three years and ten months in custody. The
appeal may take some time to come on Board for hearing.

8. In the circumstances, the sentence of appellant stands suspended
during the pendency of appeal and he be released on bail on executing a
personal bond of Rs.10,000/- with one surety of the like amount to the
satisfaction of the learned Trial Court/Duty MM.

9. The appellant is directed to furnish his contact details/address to the
Investigating Officer and shall make video call to the Investigating Officer
in the first week of every month and shall keep his mobile location app open
at all time.

10. The appellant will not contact or threaten the victim in any manner,
lest it shall be a ground for cancellation of bail.

11. The application stands disposed of in above terms.

12. The earlier date fixed stands cancelled.

13. Copy of this order be sent electronically to the learned Trial Court /
Jail Superintendent for information and compliance.
