ss C.O.4168 of 2019

Shri Amit Das
Vs.
Smt. Aradhita Das

Mr. Sankha Subhra Roy
… for the petitioner

This is an application filed by the petitioner/ husband in Matrimonial Suit

No.97 of 2018 pending before the learned Additional District Judge, 14th Court,

Alipore. In this application, the husband/petitioner prays for expeditious

disposal of Matrimonial Suit No.97 of 2018.

It is submitted that the respondent/wife has filed an application under

Section 24 of the Hindu Marriage Act for maintenance pendente lite and the said

application is pending disposal.

Under such circumstances, the learned Additional District Judge, 14th

Court, Alipore, is requested to dispose of the Matrimonial Suit No.97 of 2018

along with all pending applications within a period of one year from the date of

communication of this order. Needless to mention, if there is an order of

maintenance pendente lite and the husband neglects to pay, this order shall not

bind the learned Additional District Judge, 14th Court, Alipore.

It has been pleaded that there is urgency in disposal of the Matrimonial

Suit since the petitioner is serving in a foreign location and he would find it

difficult if the suit drags for a long time.

2

In case the Court is vacant, the petitioner is at liberty to take out an

application before the learned District Judge, Alipore for transfer of the suit to an

appropriate Bench having jurisdiction.

This revisional application is, thus, disposed of.

There shall be no order as to costs.

Urgent certified copy of this order, if applied for, be handed over to the

parties on priority basis.

(Shampa Sarkar, J.)
