This Petition is filed under Section 439 of Cr.P.C. praying
to enlarge the petitioner on bail in Cr.No.10/2017 of N.R. Pura
Police Station, Chikmagaluru District for the offences P/U/S
498A, 306 of IPC.

This Petition coming on for orders this day, the Court
made the following:

ORDER

The respondent police have registered a case

against the petitioner in Cr.No.10/2017 dated

30.1.2017 in respect of the offences punishable under

Sections 498A 306 of IPC.

2. The allegations is that the petitioner was

married to deceased Mallika for last 16 years. They

have two daughters from the wedlock. A breach

developed in their matrimonial relationship and the

petitioner used to verbally abuse the deceased and

insisted her and the children to get away from his

house, that prompted the deceased to commit suicide

by hanging herself on 29.01.2017.

3. Learned Counsel Sri. M.S. Shyam Sundar,

appearing for the petitioner submits that the deceased

Mallika was suffering from depression and was treated

at Sridhar Nursing Home and Malnad De-addiction

Centre, Shivamogga. In their entire marital life, there

was no bickering till her death. The mother of the

deceased has lodged a complaint perhaps out of sheer

suspicion.

Learned HCGP opposes the bail petition.

Perused the prosecution papers. Except ligature

marks around the neck of the deceased, no other

injury is forth coming from the inquest report . Since

major portion of the investigation is complete, there is

no impediment to allow the petition.

Petition is allowed.

Petitioner is enlarged on bail on executing a self

bond for Rs.1,00,000/- with one surety for the likesum

to the satisfaction of the concerned Court.

He shall appear before the I.O. for further course

of investigation and whenever call for.

He shall not threaten prosecution witnesses.
