This application under Section 482 of the Code of
Criminal Procedure is filed jointly by the applicant no. 1 –
husband and the applicant no. 2 – wife praying that the
charge-sheet registered as Regular Criminal Case
No. 4658/2018 against the applicant no. 1 for the offences
punishable under Sections 498A, 323 and 504 of the Indian
Penal Code, be quashed.

The matter was called out in the morning session.
The applicant no. 1 – Pritam Kishor Dongre, identified by the
advocate representing the applicants, was present. The
applicant no. 2 was not present. The learned advocate for the
applicants stated that the applicant no. 2 would be attending
the Court. The matter was kept back. When the matter is
called out in the afternoon session, again the applicant no. 2
is not present.

The learned advocate for the applicants, in such
situation, requested that the applicant no. 1 be permitted to

show the applicant no. 2 as the non-applicant no. 2 in the
cause title of the criminal application.

Leave as prayed for is granted.

Issue notice to the non-applicants, returnable on
23/04/2019.

Shri S.M. Ukey, Addl. PP waives notice for the
non-applicant no.1.

There shall be interim order in terms of prayer
clause (2) until further orders.

In addition to the usual mode, the applicant shall
serve the non-applicant no. 2 by SP/RPAD.
