4 10-07-2019 The present Miscellaneous Appeal has been

preferred for setting aside the judgment dated 07.09.2018 passed

by the learned Principal Judge, Family Court, Nalanda at

Biharsharif in Guardians and SectionWards Act Case No. 9 of 2014,

whereby the appellant’s application, for custody of the minor

grandchildren, under Sectionsections 9 and Section10 of the Guardians and

SectionWards Act, has been rejected.

This is not in dispute that the appellant’s son, Rinku

Kumar was married with respondent no. 1, Priyanka, but after

his death, the respondent no. 1 got married with respondent no.

2 Niraj Kumar, with whom two minor children are residing.

Issue notice to the respondent nos. 2 and 3 through

both process i.e. ordinary as well as under registered cover

with A/D, for which requisites etc. must be filed by 25 th July,

2019, failing which this appeal shall stand rejected without

further reference to the Bench.

List this matter on 20.08.2019.
