C.R.M. 340 of 2018
sg Ct. No.28
In Re: – An application for anticipatory bail under Section 438 of the
(Allowed)
Code of Criminal Procedure filed on 10/01/2018 in connection with
Kharagpur (Local) P.S. Case No. 529/2017 dated 22.11.2017 under
Sections 498A/302/201/120B of the Indian Penal Code.

And

In the matter of: Sima Das
….petitioner
Mr. S Das Mahapatra, Adv.

…for the petitioner
Mr. Saswata Gopal Mukherjee, PP
Mr. R. D. Nandy, Adv.

…for the State

Petitioner is the married sister in law of the victim housewife who resided separately

from the couple. It is submitted that the victim committed suicide 17 years after her marriage.

Learned lawyer for the State opposes the prayer for bail.

Having considered the materials in the case diary and bearing in mind the submission

that the petitioner resided separately from the couple and that the victim committed suicide 17

years after marriage, we are of the opinion that custodial interrogation of the petitioner may not be

necessary in the fact of the case and the petitioner may be granted anticipatory bail.

In the event of arrest, the petitioner shall be released on bail upon furnishing bond of

Rs.10,000/- (Rupees Ten Thousand only) with two sureties of like amount to the satisfaction of the

arresting officer subject to the conditions as laid down under Section 438(2) of the Code of

Criminal Procedure, 1973.

The application for anticipatory bail is, accordingly, allowed.

Urgent photostat certified copy of this order, if applied for, be supplied expeditiously

after complying with all necessary legal formalities.
