sg Ct. No.28 C.R.M. 2755 of 2018
In Re: – An application for anticipatory bail under Section 438 of the Code of Criminal
Procedure filed on 14.05.2018 in connection with Keshpur P.S. Case No. 52/2018
(Allowed) dated 23.03.2018 under Sections 498A/307/323/406/506/34 of the Indian Penal Code
and Section 3/4 of the DP Act.

Sk Dilbar Hossion @ Felu @ Sk Dilbar Hossain Ors.

Versus
State of West Bengal

Mr. S. Das Adhikari, Adv.

…for the petitioners.

Mr. S.S. Imam Adv.

Mr. R. Jana, Adv.

…for the State.

It is submitted on behalf of the petitioners that there is an inordinate

delay in lodging the first information report. It is further submitted that the

allegations against the petitioners who are the in-laws of the housewife are

general and omnibus in nature.

Learned lawyer for the State opposes the prayer for bail.

Having considered the materials on record and bearing in mind the

extent of complicity of the petitioners in the alleged crime and the fact that

there is delay in lodging first information report, we are inclined in granting

anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest, the petitioners shall

be released on bail upon furnishing a bond of Rs. 10,000/- each with two

sureties of like amount each, to the satisfaction of the arresting officer and also

subject to the conditions as laid down under Section 438(2) of the Code of

Criminal Procedure, 1973

The application for anticipatory bail is, thus, disposed of.

(Ravi Krishan Kapur, J.) (Joymalya Bagchi, J.)
