1. The petitioner has moved this misc. petition under Section

482 Cr.P.C. for fair investigation in FIR No.350/2016 of Police

Station Ratanada, Jodhpur Mahanagar.

2. The proper course available to the petitioner in such matter

is to approach the concerned Court within whose jurisdiction the

police station is situated to seek report about progress in the case.

3. From the reply submitted by the counsel for the State in S.B.

Criminal Misc. Petition No.1538/2017, it is apparent that the police

has found it to be a case under Section 406 IPC. Hence, there

remains no ground for entertaining the misc. petition seeking fair

investigation.

4. The misc. petition is accordingly dismissed. The petitioner

would be at liberty to approach the concerned Court for seeking a

report about the progress in the case.
