The instant bail application under Section 439 Cr.P.C. is

arising out of FIR No.162/2017, registered at Police Station

Shergarh, District Jodhpur for offence punishable under Sections

498A 304B IPC.

Police, after completing investigation, submitted charge-

sheet in the matter.

It is argued by learned counsel for the petitioner that she

has been falsely implicated in the matter. Learned counsel would

contend that being sister-in-law (Jethani) of deceased Ms. Mitiya

per se demand of dowry and other allegation of harassing her are

far-fetched. It is further submitted by learned counsel that after

investigation charge-sheet in the matter has been filed, and

therefore, considering her status as woman she may be enlarged

on bail.

Learned Public Prosecutor has opposed the bail application of

petitioner.

Having regard to the facts and circumstances of the case,

without expressing any opinion on merits, I feel persuaded to

enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is

allowed and it is ordered that accused-petitioner Smt. Nijro Devi

W/o Babu Ram, arrested in connection with F.I.R. No.162/2017,

Police Station Shergarh, District Jodhpur, may be released on bail;

provided she furnishes a personal bond of Rs.50,000/- with two

surety bonds of Rs.25,000/- each to the satisfaction of the learned

trial Court with the stipulation to appear before that Court on all

dates of hearing and as and when called upon to do so.
