Re: C.A.N. 9952 of 2017

In this case the appellant wife says that her suit

for dissolution of marriage by divorce was dismissed by

the court below on 30th November, 2013.

An affidavit-of-service is on record.

It is stated there in that the husband refused


In those circumstances we dispose of the

application for maintenance pendente lite (C.A.N. 9952 of

2017) by recording and accepting the submission of Mr.

Bera for the appellant that the respondent husband’s net

monthly income is about Rs.30,000/- p.m.

We direct the respondent husband to pay as

maintenance pendente lite Rs.5,000/- to the

appellant/wife by the seventh of each succeeding month

in advance beginning from July, 2018. The amount for

July, 2018 may be paid by 23rd July, 2018.

We also expedite the appeal.

We record that the paper books have already

been filed in this Court.

List this appeal for hearing on 8th August, 2018.

The application (C.A.N. 9952 of 2017) is

disposed of.
