appellant.
Shri R.K. Soni, learned counsel for the respondent.

Vide I.A.No.1025/2011, the appellant seeks
maintenance pendente lite.

It is contended that the appellant has no

independent source of income and is dependent on her

parents for her livelihood, whereas the respondent is an

employee having a definite source of income.

Though, the respondent has denied the liability. It

is also contended that it is the appellant who is

instrumental in creating discordance in the marital

status. It is also contended that the appellant is living

in a parental house as would warrant any maintenance

for her livelihood.

The contention raised on behalf of the respondent

is taken note of and rejected. It being not disputed by

the respondent that he is employed and has definite

source of income. The pay slip filed by the respondent

reflects the said status. We are inclined to dispose of

I.A.No.1025/2011 with a direction to the respondent to

pay appellant Rs.7,000/- (Rupees Seven

Thousand) per month on or before 10 th day of each

Gregorian (English) month through her bank account

from the date of application i.e. 4.3.2011. The

respondent shall deposit the amount in the account of

appellant. The appellant shall disclose her account

number to the respondent.

It is made clear that in case if the respondent

fails to abide by the order, the appellant would be at

liberty to file an appropriate application before the

respondent’s employer who shall deduct the amount

from the salary of the respondent and deposit the same

in the account of the appellant.

I.A.No.1025/2011 is disposed of finally in above

terms.
