Affidavit of service filed in Court today be kept with the record. The affidavit-of-service

shows that service on the learned Public Prosecutor and the envelop under Speed Post addressed

to Smt. Chandrani Paul addressed at 1/8, Gurudas Dutta Garden Lane, Police Station – Ultadanga,

Kolkata – 700 067 appears to have been returned with a postal endorsement “not known”. This

would have been considered as a valid service had there been the endorsement of such note by

the Postal Department preceded by several dates for not having claimed.

In this case the prayer of the petitioner is for quashment of the proceeding being

G.R.Case No. 467 of 2009 under Section 498A/406/34 of the Indian Penal Code pending in the

Court of the learned Additional Chief Judicial Magistrate, Bidhannagar including order dated May

11, 2017 in connection therewith. It appears that this case has been initiated on the basis of a

written complaint filed by Smt. Chandrani Siddhanta, wife of Sovon Siddhanta stating that she is

the resident of no. 5, Duff Lane, Police Station – Bartala, Kolkata 700 006. So the petitioner is

required to send copy or notice upon the Opposite Party No. 2, Smt. Chandrani Paul at the said

address by the Speed Post with Acknowledgement Due.

List the matter on June 04, 2018 (on top). In the meantime there shall be stay of all the

proceedings of G.R.Case No. 467 of 2009 under Section 498A/406/34 of the Indian Penal Code

pending in the Court of the learned Additional Chief Judicial Magistrate, Bidhannagar.

Learned Additional Chief Judicial Magistrate, Bidhannagar is directed to submit a report by

the date fixed in regard to the status of the pending case before him as mentioned above.

Let a communication of this order be made to the learned Additional Chief Judicial

Magistrate, Bidhannagar by the department concerned immediately.

Urgent photostat certified copies of this order, if applied for, be made available to the

parties upon compliance of the requisite formalities.
