This criminal petition is filed under Section 438
Cr.P.C., praying to enlarge the petitioners on bail in the
event of their arrest in Crime No.64/2017 of Jayapura
Police Station, Mysuru District for the offence punishable
under Sections 498A, 304B, 302 read with 34 of IPC.
This criminal petition coming on for orders this day,
the Court made the following:
The petitioners along with co-accused were arrayed
as accused No.4 and 5 respectively in Crime No.64/2017
registered by the Police in respect of the complaint lodged.
2. The allegation is that the deceased Megha was
married to 1st accused – Harsha Alias Soma. Subsequent
to the marriage, the accused persons being the husband,
in-laws and relatives harassed the deceased for cash
amount of Rs.5,00,000/- and she was threatened of dire
consequences. Consequently, the victim committed suicide
by hanging herself.
3. Learned Counsel for the petitioners submits that
they are not the members of the family of the 1st accused
and they have been falsely implicated. They had not
indulged or joined the petitioner either in harassing or
assaulting the deceased.
4. The mother-in-law of the deceased is already
enlarged on bail by this Court in Criminal petition
Having regard to the said submission, there is no
impediment to allow the petition.
Accordingly, the petition is allowed. Petitioners are
granted anticipatory bail in Crime No.64/2017 for a period
of three weeks subject to the following conditions:
(i) They shall surrender before the respondent-
Investigating Officer within the above said
(ii) In the event of their arrest by the respondent-
Investigating Officer in respect of the above
case, they shall be released on bail on each of
them executing a self bond for a sum of
Rs.1,00,000/- with one surety for the likesum.
