This is an application under Section 482 of the Code of
Criminal Procedure filed by the petitioners being the husband
and in-laws of the opposite party no. 2 praying for quashing
of the proceedings arising out of Dinhata Women Police
Station Case No. 99 of 2019 dated December 24, 2019 under
Sections 498A/506 of the Indian Penal Code and under
Sections 3 and 4 of the Dowry Prohibition Act.
Learned counsel appearing for the petitioners submits
that the petitioners already initiated criminal proceedings
against the defacto complainant being Dinhata Police Station
Case No. 531 of 2019 dated December 22, 2019 under
Sections 341/325 and 34 of the Indian Penal Code and the
criminal proceedings initiated by the defacto complainant

against the present petitioner is nothing but the counterblast
of that proceedings.
Having regard to the submissions made by learned
counsel appearing for the petitioners and considering the
materials placed on record, the petitioners are directed to
serve the copies of the present revisional application along
with all annexed documents to the opposite party no. 1/the
State of West Bengal through the office of the learned Public
Prosecutor and to the opposite party no. 2 by speed post with
acknowledgement due within one week from date and to file
affidavit-of-service within two weeks thereafter.
Let the matter appear in the list under the same
heading “Listed Motion” two weeks hence.
Urgent photostat certified copies of this order, if applied
for, be given to the parties upon compliance of all necessary
formalities.
