ORDER

This is third repeat bail application under Section 439 of
Cr.P.C. in connection with Crime No.346/2017 under
Section 376, 506 of IPC registered at Police Station-
Nanakheda, District-Ujjain.

2. First and second bail applications were dismissed as
withdrawn vide orders dated 11/10/2017 and 29/11/2017
passed in M.Cr.C. Nos.9785/2017 and 22936/2017 respectively.

3. Learned counsel for the applicant submits that present
applicant is innocent and has falsely been implicated in the
present case. There is no evidence against him. Conclude of
trial is likely to take time. The applicant is permanent resident
of District-Ujjain. There is no possibility of absconding. He is
ready to furnish adequate security, therefore, he may be
released on bail.

4. Per contra, learned Public Prosecutor for the State
opposes the bail application and prays for dismissal of the
application.

5. This time the present applicant has come before this
Court with the statement of prosecutrix recorded by the
M.Cr.C. No.14586/2018 2

learned trial Court. Though in her examination-in-chief the
prosecutrix has reiterated her allegation but in the cross-
examination several facts have come on record. Relevant
paras are 4 to 10 which reads thus :-

6. The witnesses – Arjun Rathore and Mahesh Rathore who
have produced by the prosecution to prove that the present
applicant had uploaded the video on you-tube have turned
hostile.

7. The accused is in custody from 02/08/2017.
Investigation is over and charge sheet has already been filed.
Trial is likely to take time.

8. In view of the aforesaid and other facts and
circumstances of the case coupled with the period of
detention, I deem it proper to release the accused/applicant
on bail. Therefore, without commenting on merits of the case,
the application is allowed.

9. It is directed that the applicant Subhash S/o Umrao
be released from custody on his furnishing a personal bond in
the sum of Rs.30,000/- (Rupees Thirty Thousand Only)
with one solvent surety of the like amount to the satisfaction
of the Trial Court for his appearance before the Trial Court as
and when required further subject to the following
conditions :-

(i) The applicant shall co-operate with the trial
and shall not seek unnecessary adjournments on
frivolous grounds to protract the trial;

(ii) The applicant shall not directly or indirectly
allure or make any inducement, threat or promise
to the prosecution witnesses, so as to dissuade
him from disclosing truth before the Court;

(iii) The applicant shall not commit any offence
or involve in any criminal activity;

(iv) In case of his involvement in any other
criminal activity or breach of any other aforesaid
conditions, the bail granted in this case may also
be cancelled.
