The petitioner is apprehending his arrest in connection with Satgawan P.S.

Case No. 60 of 2016, corresponding to G.R. No. 1193 of 2016 for the offence under

section 406 I.P.C.

It appears that earlier the petitioner had moved A.B.A. No. 805 of 2017

before this court, in which petitioner was ordered to deposit Rs. 6,81,000/- before

the District Cooperative Officer, Koderma latest by 20.09.2017 and he was

granted provisional bail but the petitioner did not comply the order and he has not

deposited the said amount thereafter provisional bail granted to the petitioner

under order dated 22.06.2017 was recalled and the said anticipatory bail

application was rejected. Thereafter this anticipatory bail application has been

filed.

In para 7 8 of this anticipatory bail application it has been stated that

during pendency of the A.B.A. No. 805 of 2017 on 22.06.2017 the Hon’ble Court

has directed to deposit 25% of the alleged amount I.e Rs. 6,81,000/- and the

alleged amount is Rs. 27,24,000/-. The petitioner has already deposited Rs.

3,50,000/- through Cheque/Demand Draft of UCO, Bank deposited in S.B.I Bank

and due to unavoidable circumstances, the petitioner could not deposit the

balance amount of Rs. 3,31,000/-.

Under these circumstances, the petitioner is directed to deposit the

aforesaid amount before the District Cooperative Officer, Koderma latest by

04.12.2017

.

Further, counsel for the petitioner is directed to take instruction as to

whether the petitioner is ready to pay cost of Rs. 25,000/- as a condition of bail to

be deposited before the Secretary, District Bar Association, Civil Court, Koderma.

List this case on 11.12.2017.

Till then no coercive step shall be taken against the petitioner in connection

with Satgawan P.S. Case No. 60 of 2016, corresponding to G.R. No. 1193 of 2016

pending in the court of learned Chief Judicial Magistrate, Koderma.

Let a copy of this order be communicated to the concerned trial court

through FAX.
