Learned counsel for the petitioner seeks permission to withdraw the Contempt Petition with liberty to raise all points and issues in divorce petition which the petitioner is likely to file as the respondent has failed to abide by the agreed terms and conditions.

Learned Counsel for the respondent has however submitted that there are good grounds and reasons why the respondent does not want to reside and co-habit with the petitioner.

Recording the aforesaid submissions, and without making any comments in favour of the petitioner or the respondent, the Contempt Petition is dismissed as withdrawn leaving it open to the petitioner to file a fresh divorce petition.
