In Re: – An application for anticipatory bail under Section 438 of
the Code of Criminal Procedure filed on 05/02/2020 in
connection with Bhadreswar P.S. Case No. 376 of 2019 dated
06/10/2019 under Section 498A/304B/406/34 of the Indian
Penal Code.

And

Liberty to correct the cause title.

Having considered the materials in the case diary and keeping

in mind the extent of complicity of the petitioner i.e. the husband of

married sister-in-law of the victim housewife and in the light of the fact

that he did not ordinarily reside at the matrimonial home of the victim

housewife, we are inclined to grant anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail

upon furnishing a Bond of Rs. 10,000/- with two sureties of like

amount each to the satisfaction of the Arresting Officer and also be

subject to the conditions as laid down under Section 438(2) of the Code

of Criminal Procedure, 1973. Petitioner shall appear before the court

below and hand over his passport, if any, within four weeks from date.

In the event he does not have a passport, he shall personally appear

before the court below and furnish an affidavit to that effect within the

time frame mentioned hereinabove.

The application for anticipatory bail is, thus, disposed of.
