HON’BLE MR. JUSTICE P.K. LOHRA
Order
20/07/2017

Petitioners have filed these pre-arrest bail applications

apprehending their arrest in connection with FIR No.53/17 Police

Station Mahila Thana, District Sri Ganganagar.

In the FIR aforesaid, petitioners are charged for offences

punishable under Sections 406, 498A, 354, 420 and 323 IPC.

[ CRLMB-4852/2017]

I have heard learned counsel for the petitioners, learned

Public Prosecutor, and perused the materials available on record

including the case diary.

Upon perusal of the available material and case diary, in the

backdrop of criminal delinquency attributed to the petitioners, I

am at loss to say that no case for pre-arrest bail is made out.

Undeniably, the petitioners are charged for offence under

Sections 406, 498A, 420 and 323 IPC and petitioner Iqbal Singh is

charged for offence 354 IPC, and investigation in the matter is still

in vogue. In view thereof, I feel persuaded to thwart both these

bail applications.

Accordingly, both these pre-arrest bail applications are

rejected.

Before parting, it is observed that in case petitioners

surrender before learned trial Court and apply for bail, their bail

application(s) be considered objectively, strictly in accordance with

law.

( P.K. LOHRA)J.
