Petitioner seeks transfer of a case bearing No.GW/37/2015,
titled as “Swaran Singh vs General Public and others”, filed under
Sections 10 and 24 of the Guardians and Wards Act, 1890, pending in the
court of learned Guradian Judge-cum-Addl. Civil Judge (Sr. Divn.),
Kapurthala to a court of competent jurisdiction at Jalandhar.
None has appeared for the respondent today to contest the
petition.
Heard.
It is stated on behalf of the petitioner that two other cases
between the parties are already pending at District Courts, Jalandhar. The
petitioner has got a minor son.
It comes out that the case sought to be transferred was filed on
30.10.2015 and the written statement was filed on 08.07.2016. The distance
between Kapurthala and Jalandhar is around 20 Kms. only, which is like
going to a local place.

Considering the fact that same time is taken while visiting the
busy market of Jalandhar itself, no ground is made out to transfer the
aforesaid case.
As such, present petition is dismissed.
