2.ThepetitioneristheaccusedinCrimeNo.2227of2019

oftheSasthamkottaPoliceStationinKollamDistrictforthe

offencespunishableunderSecton498ASectionofIndianPenalCode.

3.Theprosecutioncaseinbriefisashereunder:

Thedefactocomplainantisthewifeoftheaccused.

Theaccusedmarriedthedefactocomplainanton05.11.2018in

accordancewiththecustomprevailingamongthecommunity.

Thereafter,thedefactocomplainantlivedatthematrimonialhome

oftheaccusedforaperiodofthreemonths.Thedefacto

complainantfiledapetitionbeforetheDistrictPoliceCheif,(Rural)

Kollamallegingthattheaccusedill-treatedthedefacto

complainantandtreatedherwithcruelty.

theFamilyCourt,Chavaraagainstthedefactocomplainant

seekingrecoveryofgoldornamentsallegedtohavebeen

entrustedtoherasperAnnexure-Bcomplaint.Goingbythecase

diary,itappearsthatthepartiesareatloggerheadsinconnection

withamatrimonialdispute.Annexure-BOriginalPetitionis

pendingbeforetheFamilyCourt,Chavarabetweenthesame

parties.Consideringthefactthatthedisputeinvolvedispurelya

matrimonial,itisjustandpropertograntanticipatorybailtothe

petitioneronthefollowingconditions:-

1)Thepetitionershallbereleasedonbailintheevent
ofhisarrestbythepoliceinCrimeNo.2227of
2019oftheSasthamkottaPoliceStation,Kollam
DistrictonhisexecutingabondforRs.50,000/-
(RupeesFiftythousandonly)withtwosolvent
suretieseachforthelikeamounttothe
satisfactionofthearrestingofficer.

2)Thepetitionershallappearbeforethe
InvestigatingOfficerasandwhendirectedbyhim
inwritingtodoso.

3)Thepetitionershallnotinanymannerintimidate
orinfluencetheprosecutionwitnesses.

4)Ifthepetitionerviolatesanyoftheabove
conditionsofbail,itisopentotheCourthaving
BailAppl..No.9283OF2019
