This appeal has arisen from the judgement and decree of the trial

Court by which a petition by the appellant-husband filed under Section 13 (i)

(iii) a b of the Hindu Marriage Act, 1955 was dismissed.

There is no doubt that the appellant is in arrears of payment of

maintenance pendente lite. However, the appellant, who is present in Court has

instructed his counsel to withdraw the appeal.

We allow the appellant to withdraw the appeal but with the rider

that the respondent-wife would be entitled to execute the order for recovery of

maintenance in accordance with law.

Dismissed as withdrawn.
